Purchase Terms

1 Order acceptance and payment

Ready Pool, LLC is Seller; the named purchaser is Buyer. This completed order, Sections 1–10 and listed attachments form the Agreement. After reviewing them and accepting the checkout submission terms, Buyer may pay the deposit or full price. Payment submits an order request. Acceptance requires Buyer signature, authorized Seller countersignature and delivery of the accepted copy. Buyer may withdraw for a full refund before acceptance; declined or expired unaccepted requests are also fully refundable. Production requires acceptance and cleared required payment. Earlier legal duties still apply.

The deposit is credited to the price. The balance is due on written readiness notice and must clear before release; Seller provides reasonable completion evidence on request. Payment does not waive inspection rights. Accepted methods are wire, ACH, check, cash and approved online methods; signing alone authorizes no debit. Checks: Ready Pool, LLC, 6201 N Nebraska Ave., Tampa, FL 33604. Verify changed bank instructions by phone.

Seller collects required taxes; Buyer pays lawful uncollected use tax without duplication. Out-of-state addresses alone do not establish exemption; provide exemption evidence. Seller explains tax corrections and pays its own penalties. Financing does not excuse performance absent a signed contingency. Seller will not require false delivery certifications.

2 Changes

Both parties must accept written changes to scope, price, destination or dates, including price and timing effects. Material substitutions need Buyer approval; unavailable items remain subject to lawful cancellation and remedies. Website updates cannot change signed terms.

3 Buyer cancellation and default

Cancellation is effective on receipt at finance@readypool.com or Seller's business address. Seller stops avoidable costs. After acceptance but before production, deductions are limited to documented, reasonable, nonrecoverable order-specific costs, capped at $3,000 per cancelled pool. After production, lawful proven damages may exceed the deposit. Seller credits refunds, reuse, resale and avoided costs, itemizes deductions and refunds excess payments. No automatic forfeiture or double recovery applies.

Production requires dated evidence and Buyer notice of actual fabrication, customization or irrevocable order-specific procurement; ordinary inventory or a status label does not qualify. Undisputed payment default or refused agreed pickup requires written notice and ten calendar days to cure before cancellation; Seller may suspend work or release meanwhile. Lawful rejection, warranty and refund rights remain.

4 Dispatch delays and refunds

Seller must reasonably support its agreed date. Shipment means carrier handover; pickup readiness means the conforming pool is available with notice. Delays require timely reasons, revised dates, a full-refund cancellation option for the unshipped portion and legally required consent, renewed for further delays. Silence is not indefinite consent. Document Buyer changes and agreed revised dates.

Buyer also may cancel an unfulfilled portion more than 15 calendar days late for a full refund of related payments to Seller. This supplements earlier rights, not a grace period. Seller cancellation or inability to supply likewise requires refund. Mandatory shipping refunds are due within seven working days where required, or sooner by law, without deductions or compulsory store credit. Uncontrollable events require notice and mitigation and do not remove refund rights.

Delivery and Responsibilities

5 Transport title and inspection

Buyer pays transport unless included. For a Seller-contracted carrier, Seller bears transit risk to the agreed destination and availability for unloading under the accepted quote. For Buyer pickup or a Buyer-contracted carrier, Buyer bears transit risk after safe loading and documented handover. Each party remains responsible for damage it causes; conforming delivery and mandatory legal duties remain.

Title passes after full cleared payment and physical handover to Buyer or carrier, without changing risk allocation. Seller supplies available identification, dispatch and condition records. Disclose cargo coverage and carrier deadlines before handover. Insurance is included only as stated. Added storage, waiting, redelivery or access fees need an accepted amount or calculation basis beforehand, except lawful damages.

Inspect on receipt; photograph and record damage or shortages and promptly notify Seller. Report concealed defects promptly after discovery; preserve evidence and allow reasonable inspection. A receipt does not waive warranty or statutory rights. Separate carrier deadlines may apply; both parties cooperate with claims.

6 Installation and safety

Buyer arranges excluded site work and confirms feasibility before production using Seller's accurate specifications and instructions. Use qualified, appropriately licensed and insured professionals. Referrals do not guarantee independent contractors' work or local approval. Buyer contracts directly with them; Seller retains responsibility for its own work, representations and nondelegable duties. Seller-sold installation requires appropriate licensed-contractor documents and notices.

Do not bury, backfill, structurally modify, use unsupported placement or move a filled pool without approval under the instructions and by a qualified professional. Container or portable construction does not establish permit exemption. Rental, commercial or public use requires suitability and code review before acceptance.

Follow installation and care instructions; complete required inspections, barriers, alarms or covers before use. No diving or jumping. Continuously supervise children and vulnerable users. Do not operate with missing or damaged suction covers. Qualified professionals handle bonding, grounding and gas work. Give instructions to later users. Seller supplies safety instructions and required notices; acknowledgment neither replaces them nor waives injury or defect claims.

7 Disputes and contract administration

Notify the other party of concerns and requested solutions. Mediation is voluntary and does not restrict claims, emergency relief or deadlines. Florida law and Hillsborough County state court or its serving federal court apply only where lawful; mandatory consumer protections, protected forums and small claims remain available. Recover fees only as law or later agreement permits.

Send notices to order contacts; use another reasonable method after delivery failure. Mandatory methods and deadlines control. This Agreement replaces negotiations without disclaiming fraud, binding express warranties or nonwaivable rights. Signed amendments identify changed terms. Sever invalid terms if the lawful bargain can remain; delayed enforcement is not permanent waiver. Assignment needs consent unless law permits; it does not release existing duties. Pool resale remains lawful, subject to warranty transfer terms. Payment accounting, warranty and dispute obligations survive.

8 Ready Pool Limited Warranty

Warrantor: Ready Pool, LLC | finance@readypool.com | (813) 330-7599
9353 E. Fowler Ave., Thonotosassa, FL 33592

Coverage begins on actual Buyer delivery or collection, for the original retail Buyer. Transfer requires Seller's written agreement unless law requires otherwise. Provide this complete warranty before payment or signature.

Warranty coverage
Covered itemCoverage period
Fiberglass shell and shipping-container structureWhile the original retail Buyer owns the pool
Factory-supplied components and purchased factory optionsThree years from delivery or collection

This defines the lifetime limited shell/container warranty. Coverage is for materials and workmanship defects. Components include the pump, filter, lights, bubbler and controller. Maintenance remains required. Any supplied manufacturer warranty adds to, and does not reduce, Seller's coverage.

Remedy. Seller inspects and chooses repair or replacement with new or functionally equivalent items, paying covered parts and reasonable repair labor. If no effective remedy is provided within a reasonable time, lawful refund, replacement and other remedies remain. Repairs do not restart coverage unless law requires.

Access and costs. Buyer provides safe access. Maintenance, water, chemicals, loss of use, site-improvement removal or rebuilding, and extraordinary crane, removal, reinstallation, travel and freight costs are excluded unless agreed or legally required. Obtain approval before charging noncovered costs; exclusions cannot defeat a legally required effective remedy.

Exclusions. Ordinary fading, weathering, finish renewal, consumable wear and resurfacing due to wear are excluded; premature defect-related failure remains covered. Exclude damage only to the extent caused by improper lifting, installation, support, maintenance or water chemistry; alterations; misuse; freezing; external corrosion; or external casualty. Seller identifies the cause of denial; unrelated coverage remains.

Service. Promptly report problems with order number, proof of purchase, description, photos and relevant care records. Seller explains inspection and service. Agree shipping and reimbursable repairs in writing first, except reasonable emergency protective measures. Independent service alone does not void coverage; resulting damage may be excluded.

This warranty gives you specific legal rights, and you may also have other rights which vary from state to state. No implied warranty is disclaimed. Some states do not allow the exclusion or limitation of incidental or consequential damages, so those limitations may not apply to you.

9 Liability limits and preserved rights

TO THE EXTENT LAWFUL, SELLER EXCLUDES INDIRECT, INCIDENTAL, SPECIAL AND CONSEQUENTIAL ECONOMIC LOSS, INCLUDING LOST REVENUE, PROFIT AND USE, AND CAPS DIRECT ECONOMIC LOSS AT THE CONTRACT PRICE OF THE AFFECTED POOL AND OPTIONS.

These limits exclude personal injury, death, fraud, gross negligence, willful misconduct, other-property damage caused by Seller negligence and nonwaivable liability. They do not excuse warranty performance, required refunds, conforming delivery or statutory remedies, including failure of a limited remedy's essential purpose. Each party retains responsibility for its acts and those legally attributable to it. Buyer assumes no Seller negligence or product-defect liability.

Electronic Consent and Signatures

10 Your electronic records choice

Electronic delivery is optional, by email or secure portal with email notice, for this order's agreement, schedules, warranties, safety disclosures, changes, invoices, receipts, dispatch/delay notices, cancellations and refunds. It does not include marketing consent or other purchases.

For paper signing, free paper copies, withdrawal of future electronic delivery or contact updates, send your name, order number and request to finance@readypool.com, (813) 330-7599 or Seller's business address; include a mailing address for paper. No fee applies. Withdrawal takes effect within a reasonable time, without cancelling the purchase, changing its economics or invalidating earlier proper records/signatures. Seller explains paper delivery; legal deadlines remain.

You need internet, email, a supported browser, PDF access and the ability to save or print. Any additional provider requirements appear before consent. Open the agreement or same-format access PDF and complete the access check before consenting; use paper if access fails. Material technology changes require updated disclosures and renewed consent as required by law.

After review and correction, an intentionally adopted typed or drawn signature signs this identified version. Seller supplies the accepted copy and completion record. Counterparts may form one Agreement. Evidence includes name, email, authentication, consent, timestamps, version and IP/device details under disclosed privacy practices; it does not prevent contesting unauthorized signatures or inaccurate records.
